General terms and conditions of sale of gift vouchers

The terms defined below have the following meaning in the present special conditions of sale of gift vouchers :

Gift voucher : the document containing the offer, place, validnumber, validity, date and a description to take advantage of an offer in our establishment.

The gift voucher can be delivered by e-mail, post or hand to hand. Confirmations or the follow-up file can onlybe sent by email.

Establishment : refers to the company issuing the gift voucher which is responsible for revenue, invoicing, delivery control, compliance, delivery and all obligations relating to the offer.

Beneficiary : The person who uses the gift voucher.

Service : Refers to the entire offer provided by the institution to the beneficiary.

Customer : refers to the person who purchases a gift certificate, it being understood that the customer may or may not be the recipient of the service depending on whether it is for personal use or a gift.

Scope of conditions

Prior to any transaction, the Customer expressly and unreservedly acknowledges and accepts these special conditions as soon as he ticks the box relating to these conditions on the online form on the www.calvi-location-villa.com website.

The customer acknowledges having the capacity to contract under the conditions described in the special and general conditions of sale, and in particular being of legal age and not being under guardianship.

1.1 Specific conditions of sale of gift vouchers.

The present special conditions of sale therefore only apply to online purchases of gift vouchers on the website www. calvi-location-villa.com.

These conditions are in addition to the general terms and conditions of sale, and to the exclusion of all other conditions, in particular those in force for sales excluding gift vouchers.

The company SAS VILLAS MANDARINE, Domaine Villas Mandarine & Spa***** reserves the right to modify these special conditions at any time and without notice, provided that these modifications do not apply to orders previously accepted and confirmed by Domaine Villas Mandarine & Spa *****.

These terms and conditions of sale exclusively govern the sales of gift vouchers by SAS VILLAS MANDARINE, Domaine Villas Mandarine & Spa****.

The rates

The rates indicated are in €uro and include VAT, and take into account the VAT applicable on the day of the reservation. Any change in the applicable rate, or any modification or introduction of new taxes introduced by the legal authorities will automatically be reflected in the prices indicated on the date of the invoice.

The accommodation rates do not include the obligatory accommodation costs to bepaid on site and any extras.

The rates given are applicable per gift voucher and for the number of persons indicated.

Due to the seasonality of the rates, certain costs may be charged, requested from the beneficiary or the client in the event that the value of the gift voucher does not correspond to the rates in force at the time of its consumption.

Conditions of use of gift vouchers and liability

If you are not the beneficiary of the gift voucher, please bring to the attention of the beneficiary the conditions set out below.

Only the presentation of the original voucher received by e-mail, post or hand-delivered will entitle you to the service.

The voucher entitles you to the services developed by the Domaine Villas Mandarine & Spa ***** directly by making a reservationwith the latter.

The gift voucher is valid for 1 year from the date of issue.

The service will take place after the validity of the full gift voucher has been checked and paid for. This check involves the validation of the voucher number by the establishment, to verify the effective activation of the voucher.

The granting of the service is subject to the specific conditions of the establishment, in particular in terms of cancellation or change of reservation.

The voucher is neither exchangeable, nor modifiable, nor refundable outside the validity dates and under certain conditions.

In the event of non-use during its period of validity, loss, theft or destruction of the gift voucher, the beneficiary may not request a refund or compensation of anykind, nor use subject to certain conditions.

Fees may be charged according to the different seasons and services.

It is never the less possible to extend the validity of the gift voucher subject to the agreement of the management and the application of additional charges.

1.2 Specificterms and conditions of sale of the Spa's services

Prices

Our prices are net prices. Each programme indicates the benefits and services included. Valid for the current year from 1 January to 31 December, except for year changes due to changes in legislation, VAT rates or special promotional offers.

Special offers are subject to availability, cannot be modified, cannot be retroactive and cannot be combined with any current promotional offer.

Booking

All bookings will be effective upon receipt of a deposit of 30% of the amount of the treatments booked (à la carte or package).

The time of your reservation is the time at which you must start your treatment. It is recommended that you arrive 15 minutes before the time of your treatment. Any delay could lead to a reduction in the duration of the treatment or cancellation without any modification or adjustment of the price.

Rules

Your treatment is payable by cheque, creditcard or cash at the reception desk of the estate on the sameday.

For villa guests, the treatment can be transferred to the room bill.

Cancellation

Any modification or cancellation 24 hours or more before the treatment does not incur any additional cost. After this time, any modification or cancellation may be subject to additional charges.

Spa regulations

Wearing a swimming costume is compulsory in the Spa area. A soapy shower is mandatory before using the Spa facilities. Wearing a disposable thong is mandatory during massages.

The SPA is a calm space dedicated to the search for harmony of body and mind, it is important to speak calmly. Children under 16 yearsold are not accepted. Animals, cigarettes, alcohol, mobile phones and electronic games are not allowed. Any behaviour involving in decent exposure will be grounds for interruption or cancellation without refund.

Complaints

Any protests or complaints made after the departure date will not be taken into account. Any additional consumption is payable at the time of departure.

Liability

If the customer has any health problems, it is the customer's responsibility to consult a doctor before using our equipment. Under no circumstances can the Spa Villas Mandarine be held responsible for circumstances of force majeure, due to a third party and not related to the execution of the services provided for in the contractor the poor execution of the contract attributable to the client.

Applicable law

These general conditions are governed by French law. This applies to the rules of substance as well as to the rules of form. Disputes fall within the exclusive jurisdiction of the French courts.

Request

The company SAS VILLAS MANDARINE, Domaine Villas Mandarine & Spa***** reserves the right to modify these special terms and conditions at any time and without prior notice, provided that these modifications do not apply to orders previously accepted and confirmed by the Domaine Villas Mandarine & Spa *****.

The products

These terms and conditions of sale exclusively govern the sales of products and services by SAS VILLAS MANDARINE.

The rates

The rates given are applicable per gift voucher and for the number of persons indicated.

Due to the seasonality of the rates, certain costs may be charged, requested from the beneficiary or the client in the eventthat the value of the gift voucher does not correspond to the rates in force at the time of its consumption.

Reservation

A guarantee of 30% of the total amount of each reservation is required for the reservation to be considered firm and definitive (see cancellation and modification conditions for a possible refund).

Reservations, whatevertheirorigin, are payable only in €uros.

The hotel reserves the right to refuse any reservation if the credit card number is incorrect or incomplete.

No travel booked before the implementation of any promotional offer will be subject to reimbursement, even partial.

Cancellation

The 30% depositis payable on booking and is non-refundable.

For cancellations up to 30 days before arrival, only the deposit is retained.

For cancellations between 29 days and 0 days before arrival, 70% of the total amountis due.

Villa and services

Reception is open from 8:00 to 20:00 every day during the villas' opening period.

The villas are scheduled to be entered at 17:00 and must be vacated by 10:00 on the day of departure.

The client accepts and undertakes to use the villa with diligence. Likewise, any behaviour contrary to morality and public order will lead the establishment to ask the client to leave the villa without any compensation and without any reimbursement. Any protest or claim made after the departure date will not be taken into account.

Any additional consumption is payable at the time of departure.

Animals are accepted free of charge in the villas, however it is obligatory to indicate this when booking.

The villas have Wi-Fi internet access. The available computer resources must not be used, in anyway what so ever, for the purposes of reproduction, representation, makingavailable or communication to the public of works or objects protected by copyright or related rights, such as text, images, photographs, audiovisual musical works, software and video games without the authorisation of the copyright holders.

Force majeur

By force majeure is meant any event external to the parties, of a nature that is both unforeseeable and insurmountable that prevents the client or the hotel owner from fulfilling all or part of the obligations arising from the contract.

This is particularly true in the event of strikes, insurrection, riots, bans issued by the governmentor public authorities.

It is expressly agreed that force majeure suspends the parties' performance of their mutual obligations and that each party shall bear the burden of the resulting costs.

Customers shall bear any additional costs that may be incurred to enable the journey to continue, due to the occurrence of a case of force majeure.

Responsabilities

The establishment declines all responsibility in the event of theft, loss or damage to items belonging to guests during their stay.

The client will be responsible for any damage or deterioration, vandalism that may occur due to the occupation and/or due to the participants and/or the staff for which they are responsible, the movable property, decoration and real estate inside and outside the villa. Consequently, the establishment may therefore ask the guest to leave the establishment without any reimbursement for the stay, and reimburse any damage caused by suchacts.
